Kilmar Garcia Vanishes—And the Supreme Court’s Power Fades With Him

Kilmar Abrego Garcia was picking up his 5-year-old son in Maryland when ICE officers pulled him over. They told him his status had changed. They waited for his wife, then took him away. Three days later, he was on a plane to El Salvador. No warning. No goodbye.

Abrego Garcia had lived here for over a decade. A union sheet metal apprentice. Husband to a U.S. citizen. Father of three—two with disabilities. He had a 2019 court order protecting him from deportation. He fled gang violence as a teen. Still, the Trump administration deported him—calling it an “administrative error.”

Now, he’s locked inside El Salvador’s infamous mega-prison, CECOT. No charges. No contact. No way home.

A Legal System Ignored

A federal judge ordered the government to bring him back. The Supreme Court upheld that order, demanding the administration “facilitate” his return. Trump refused. He claims he has no authority to get him back from a foreign prison. His officials say U.S. courts have no jurisdiction.

Legal experts disagree. The judge who issued the order called the deportation “wholly lawless.” Yet days go by, and there is no plan—just silence.

A Dangerous Precedent

This isn’t just about Kilmar. It’s about whether a president can ignore the courts. About whether the rule of law still means anything. If the executive branch can defy a direct order from the Supreme Court, what stops it from ignoring the next one?
